Amendment to the LTVplus Privacy Policy

This document serves as an amendment to the existing LTVplus Privacy Policy and the LTVplus Information Security Policy.

1. Preamble

This amendment clarifies the policy of LTVplus (“the Company”) regarding the use of personally owned mobile devices, including but not limited to smartphones, tablets, and laptops (“Personal Mobile Devices”), to access Company data, systems, or networks. It outlines the division of responsibility, the inherent risks, and the Company’s limitation of liability concerning such use.

2. Definition of Control

LTVplus explicitly defines that Personal Mobile Devices are not owned, provided, managed, or controlled by the Company. LTVplus does not have administrative control over:

  • The device’s operating system, security patches, or updates.
  • Applications installed on the device by the user for personal use.
  • The security configurations, passwords, or biometric access controls set by the user.
  • The networks (e.g., home Wi-Fi, public Wi-Fi) to which the device connects.

Any access granted to Company systems via a Personal Mobile Device is provided solely for the convenience of our personnel and does not imply Company ownership or control over the device itself.

3. Inherent Risks of Using Personal Mobile Devices

All users must acknowledge that accessing Company data and systems through a Personal Mobile Device presents inherent security risks for which the user assumes full responsibility. These risks include, but are not limited to:

  • Data Breach: Loss of Company or client data due to malware, spyware, viruses, or other malicious software contracted by the device.
  • Unauthorized Access: Compromise of sensitive information if the device is lost, stolen, or accessed by an unauthorized third party.
  • Data Interception: Leakage of data when the device is connected to unsecured or public Wi-Fi networks.
  • Data Co-mingling: Accidental leakage of Company data through personal applications (e.g., cloud storage, messaging apps) installed on the device.
  • Device Failure: Loss of data resulting from hardware or software failure of the Personal Mobile Device.

4. User Responsibilities

As a condition of using a Personal Mobile Device to access Company resources, the user agrees to assume responsibility for implementing baseline security measures, including:

  • Enabling a strong password, PIN, or biometric lock on the device.
  • Keeping the device’s operating system and applications regularly updated.
  • Installing reputable anti-malware software, where applicable.
  • Immediately reporting the loss or theft of the device to the LTVplus IT Department.
  • Exercising caution when connecting to public or untrusted networks.

5. Disclaimer and Limitation of Liability

Given that LTVplus does not control Personal Mobile Devices, LTVplus shall not be held liable for any security incident, data breach, financial loss, or damage arising from the use of a Personal Mobile Device to access Company systems.

Specifically, LTVplus disclaims all liability for:

  • Any loss, theft, or corruption of Company data that occurs on or originates from a user’s Personal Mobile Device.
  • Any damages, losses, or costs incurred by the user or any third party resulting from a security compromise of their Personal Mobile Device.
  • The security, privacy, or integrity of any data stored, transmitted, or processed on a device not owned and fully managed by LTVplus.

The use of a Personal Mobile Device to connect to LTVplus resources constitutes the user’s full acceptance of all associated risks and their agreement to hold LTVplus harmless from any resulting claims, damages, or liabilities.

6. Acknowledgment

By accessing LTVplus systems or data with a Personal Mobile Device on or after the effective date of this amendment, all users are deemed to have read, understood, and agreed to the terms outlined herein.
